High Court, in judicial review proceedings, makes a number of declaratory reliefs in respect of an adolescent child with a disability, including that: (1) her current placement in a hospital was not in her best interests; (2) the continued placement in a hospital setting has resulted in a disproportionate and unlawful interference with her constitutional and human rights, on the basis that the placement was wholly unsuitable; and (3) the Health Service Executive's actions have been unreasonable and irrational, and has had a detrimental impact on her health.
