High Court grants an order suspending a medical practitioner from the register pending the determination of a complaint, where the practitioner was in breach of undertakings given by him concerning the prescription of drugs to patients in unusual circumstances, on the grounds that: (a) it was clear on his own evidence that the practitioner was in breach of all three undertakings given by him to the court at an urgent hearing on the application of the Medical Council; and (b) in the circumstances, the court could not be confident that the practitioner would comply with such undertakings in the future.
Professional regulation - application by Medical Council against medical practitioner - alleged breach of undertakings - whether to suspend practitioner from the register - s. 60 of the Medical Practitioners Act 2007 - prescription of drugs to patients in unusual circumstances - concerns on the part of pharmacists - urgent hearing before President of High Court - undertakings given at hearing - not to treat or prescribe medication to any patient not a patient of the respondent - to prescribe only to patients of the hospital under consultant supervision - not to communicate with persons to whom prescriptions had been issued - evidence of breaches of undertaking.
