The High Court granted an order of certiorari quashing the decision to refuse planning permission for a 24-storey mixed-use building. The court found that the planning authority failed to provide adequate reasons for its decision, particularly in relation to the building's contribution to the public realm and its visual impact on the area. The court also noted that the authority did not properly engage with the performance criteria set out in the development plan and the Urban Development and Building Height Guidelines. The case was remitted back to the planning authority for reconsideration in accordance with the law.
