High Court grants order deeming service of proceedings to be good, where a solicitor had acted for the defendant in taking out letters of administration in respect of a deceased person, on the grounds that: (a) the solicitor had recently acted for the defendant and had means of contacting her; and (b) merely because the proceedings had been served on the solicitor did not mean that the solicitor was on record or was obliged to act for the defendant in the proceedings.
Ex parte application - whether proceedings properly served - substitution of personal representative for original deceased defendant - solicitor refusing to accept service of proceedings despite having taken out letters of administration on behalf of personal representative - whether court satisfied that party was a client of the solicitor - whether solicitor had means of contacting client.
