The High Court granted an order of certiorari quashing the Planning Board's decision to grant permission for a strategic housing development. The development, as proposed, was found to materially contravene the relevant County Development Plan 2021-2027 in relation to car parking and accessible parking spaces. The Board had not correctly interpreted the Plan and failed to exercise its discretion lawfully, leading to the invalidation of its decision. The Board's decision did not address the material contravention of the Plan for electric vehicle charging points, but this was not deemed a material contravention. The development as proposed also materially contravened the Plan in relation to cycle parking spaces, but the Board imposed a condition to rectify this issue.
