Court of Appeal affirms its jurisdiction to grant access to ambient digital audio recordings (DAR) for criminal investigation purposes, specifically allowing the Garda Siochana Ombudsman Commission (GSOC) to obtain the ambient DAR from a courtroom incident, on the grounds that the ambient DAR, capturing events after the judges had risen due to disruptions, constituted a record of proceedings and that providing access to GSOC was both necessary and proportionate for the investigation of alleged criminal offenses.
